Current listing rates(Total commission you pay if a Realtor brings a buyer)

  • Listings priced up to $275,999 you pay 3.5%
  • Listings priced between $276,000 thru $375,999 you pay 3%
  • Listings priced above $ 376,000 you pay 2.5%
  • By purchasing your MLS/ Realtor.com listing you are agreeing to the following terms and conditions
  • 1)You are purchasing an exclusive agency listing on your local MLS. You will sign a Exclusive Agency Listing Agreement. With an exclusive agency listing you retain the right to sell your real property yourself and owe no commission.
  • 2) The property is located in New York state.
  • 3) You are the legal owner(s) of the property being listed as recorded on a deed and property tax rolls and you have the legal right to offer the property for sale.
  • 4) The property is not currently listed on any MLS or with any licensed real estate professional.
  • 5) Any information you provide to us is accurate and truthful.
  • 6) You will abide by all federal, state and local laws governing the sale and marketing of real estate. Including, but not limited to, fair housing laws.
  • 6) You will fully disclose any known defects of the property being listed to our agency, potential buyers and/or there agents.
  • 7) In the case of a sale brought about by any Realtor in which you pay the agreed commission you will be credited the original purchase price of your listing towards your commission due at closing. This credit does not apply to properties selling for less than $200,000.00(two hundred thousand). No credits will be given for the cost of slide shows.
  • 8) You agree to hold harmless Real-e-SmartRealty.com from any and all claims, causes of action, damages, errors or omissions relating to or arising out of inaccurate information and /or incomplete information concerning your listing and/or property for sale.
  • 9) We do not guarantee error free service. If you discover any error in your listing you must notify us of promptly to correct it.
  • 10) Yard signs are the responsibility of property owners. If a yard sign is damaged the seller agrees to pay a $60.00 replacement fee.
  • 11) In the case of a sale by owner seller(s) agrees to inform by written notification Real-e-SmartRealty.com within 24 hours of the signing of an offer to purchase contract and a closing. Seller further agrees to to submit a copy of an executed contract to Real-e-SmartRealty.com within 24 hours after all parties to the contract have signed, and a settlement statement the day of closing. This is done to keep information accurate and up to date on the MLS. Failure to do so could result in a fine to Real-e-SmartRealty.com from the MLS. Seller agrees to pay Real-e-SmartRealty.com the amount equal to any fines levied Real-e-SmartRealty.com from the MLS due to seller’s negligence in providing accurate and up to date information.
  • 11) If you wish to extend your listing at anytime. We will apply the cost of your original listing towards the extended listing price. We will automatically extend your listing at three month intervals, unless you notify us otherwise, for a period of nine full months.
  • 12) Money back guarantee: Within your e-listing package we send you will be an Exclusive Agency Agreement and required addendum. If after you review these documents you decide you do not want to list your property. We will refund your money. No refunds will be given once the property is listed on the MLS.
  • 13) You unequivocally agree that any and all claims or disputes arising out of or relating to the use of our services or websites or any acts which you claim Real-e-SmartRealty.com is liable shall be finally and exclusively settled by arbitration. The arbitrator shall not have the power to award damages in excess of actual compensatory damages and shall not award consequential, punitive or exemplary damages. If either party employs an attorney to enforce there rights under this agreement the prevailing party shall be entitled to recover reasonable attorney fees. THIS AGREEMENT PROVIDES THAT ALL DISPUTES BETWEEN YOU AND REAL-E-SMARTREALTY.COM WILL BE RESOLVED BY BINDING ARBITRATION. THUS YOU GIVE UP YOUR RIGHT TO GO TO COURT TO ASSERT OR DEFEND YOUR RIGHTS. YOU ALSO GIVE UP YOUR RIGHT TO PARTICIPATE IN OR BRING CLASS ACTIONS. YOUR RIGHTS WILL BE DETERMINED BY A NEUTRAL ARBITRATOR.
  • 14) BY PURCHASING YOUR LISTING YOU UNEQUIVOCALLY AGREE TO THESE TERMS AND CONDITIONS.
